We provide digital marketing, web development, growth strategy consultations, and automated tools, including:
- An AI Voice Agent (“Holly”) for handling inbound calls, qualifying leads, demonstrating solutions, and booking Strategy Calls.
- Transactional follow-up communications (e.g., SMS/text messages containing appointment confirmations, call summaries, or links) sent only with your explicit consent.
Services are provided “as is” and may be modified, suspended, or discontinued at any time without notice.
2. User Eligibility and Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent that you meet this requirement and have the authority to bind any entity you represent.
If account creation is required (e.g., for Strategy Calls or client portals), you agree to provide accurate information and keep it updated.
3. Communications and Consent (SMS, Voice, AI)
Inbound Calls and AI Voice Agent
Our AI Voice Agent handles inbound calls using automated speech recognition and text-to-speech.
- Calls may be processed in real time; limited recording may occur for quality assurance, training, or compliance (with notice where required by law).
- AI outputs (e.g., advice, demonstrations, booking suggestions) are generated automatically and may contain errors or inaccuracies. Do not rely solely on AI outputs for critical decisions—verify independently.
SMS/Text Messaging
We may send transactional SMS messages (e.g., appointment confirmations, call summaries, or follow-up details) only after obtaining your explicit consent, either verbally during a call or through another method.
- Consent example: Our AI agent may ask: “Would you like me to send a quick text confirmation…? Message and data rates may apply. Reply STOP to opt out. Do I have your okay?”
- We proceed only upon a clear affirmative response (e.g., “yes”).
- Consent is voluntary and is not a condition of using our core Services.
- Message Frequency: Varies (typically low; 1–5 messages per interaction).
- Carrier Fees: Standard message and data rates may apply—check with your carrier.
- Carrier Liability Disclaimer: Carriers are not liable for delayed, undelivered, or misdirected messages.
- Opt-Out: Reply “STOP” to any SMS to unsubscribe immediately. You may also opt out verbally during calls or by emailing [email protected]. We process opt-out requests promptly and send confirmation where feasible.
- Help: Reply “HELP” for assistance or contact support.
- We do not send promotional or marketing SMS without separate express written consent.

4. Intellectual Property
All content, AI models, scripts, demonstrations, and materials on the Services are owned by us or our licensors. You are granted a limited, non-exclusive license to use them solely for personal or business evaluation during interactions. No ownership is transferred.
You may not copy, reverse-engineer, or misuse our AI tools or content.
5. AI-Specific Disclaimers and Limitations
- AI outputs are probabilistic and may be inaccurate, incomplete, biased, or inappropriate.
- We disclaim any warranty that AI advice, demos, or suggestions will meet your needs or produce specific results.
- Do not use AI outputs as professional legal, financial, medical, or regulated advice—consult qualified professionals.
- We may use anonymized or de-identified interaction data to improve our AI systems (no personal identifiers are shared externally).
6. Limitation of Liability
To the fullest extent permitted by law:
- The Services are provided “as is” and “as available” without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, accuracy, or non-infringement.
- We are not liable for indirect, incidental, consequential, special, or punitive damages (including lost profits, data loss, or business interruption), even if advised of the possibility.
- Our total liability (if any) is limited to $100 or the amount you paid us in the prior 12 months, whichever is greater.
- This does not limit liability for gross negligence, willful misconduct, or where prohibited by law.
7. Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, losses, damages, liabilities, and costs (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of the Services or AI outputs, violation of laws, or any content or actions you provide during interactions.
8. Termination
We may terminate or suspend your access to the Services at any time, for any reason or no reason, including violations of these Terms. Upon termination, your right to use the Services ends.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Missouri (without regard to conflict of law principles). Any disputes will be resolved in the courts of Saint Peters, Missouri. You waive any right to participate in a class action lawsuit or class-wide arbitration.
10. Changes to Terms
We may update these Terms from time to time. Changes will be posted here with a new effective date. Your continued use of the Services after changes constitutes acceptance.
